Terms & Conditions:

These terms and conditions ("Rules") govern the{' '} "Eat & Win 2.0 Contest" contest ("Contest").

1. The Contest

1. The Contest is organized by{' '} Malaysia Airports (Niaga) Sdn. Bhd. [Registration No.: 199301026572 (281310-V)] ("Eraman").

2. The Contest will commence on 25th November 2024 and will end on 31st May 2025 ("Contest Period"). However, Eraman may, at its sole and absolute discretion, amend, shorten, extend, or cancel the Contest or the Contest Period at any time without any prior notice to any party whatsoever.

2. Contest Mechanism and Eligibility

1. The Contest is open to all customers of Eraman Food Garden Stores with a valid identification document who are aged eighteen (18) years old and above on 25th November 2024 and have fulfilled all the conditions required in these Rules ("Eligible Customers"). "Eraman Food Garden Stores" is defined and specified in Clause 2.2 below.
2. For the purpose of the Contest and these Rules, " Eraman Food Garden Stores" refers to the food and beverages outlets operating within the Food Garden area of Kuala Lumpur International Airport (KLIA) Terminal 1, as specified below:
3. Beverage & Dessert Counter operated by Eraman;
4. One (1) of the following food and beverages outlets operated by the tenant of Eraman:
5. Pastamania;
6. Starbucks;
7. O'Briens;
8. Yong Tau Foo;
9. Dunkin Donut;
10. Little Wok;
11. Malaysian Mixed Rice;
12. Chicken Rice & Claypot;
13. I Love Yoo;
14. Hadrami Mediterranean Cuisine;
15. Old Town White Coffee;
16. Asean Noodles;
17. Teppanyaki.
18. Notwithstanding Clause 2.1 above, Eraman reserves the right to disqualify any entry or participation of any Eligible Customers, in its sole and absolute discretion, at any time without assigning any reason whatsoever. Eraman shall not be responsible or liable for any losses, damages, costs, or expenses suffered or incurred by the disqualified Eligible Customers as a consequence of such disqualification.
19. To participate in the Contest, Eligible Customers shall comply with each of the following:

• a. The Eligible Customers MUST make a minimum cumulative purchase of RM80.00 or above (net value after deduction of voucher and/or discount) in two (2) purchase receipts on the same date, which shall consist of:

1. i. A minimum spend of RM20.00 or above (net value after deduction of voucher and/or discount) at Beverage & Dessert Counter, in one (1) purchase receipt; and
2. ii. A minimum spend of RM60.00 or above (net value after deduction of voucher and/or discount) at one (1) of the food & beverage outlets mentioned in Clauses 2.2 (b), in one (1) purchase receipt.

• b. The Eligible Customers are required fill in their personal information ("Personal Data") and their purchase details such as full name as per the personal identification (NRIC (MyKad) or passport), valid phone number, valid email address, price of the drink, price of the food, Receipt Number from Drink's Receipt, Receipt Number from Food's Receipt, staff or non-staff information, and shall:-{' '}

1. i. attach the original purchase receipts, in the contest form that are made available at Food Garden KLIA Terminal 1 ("Contest Form") and drop the completed Contest Form in the contest box provided at Food Garden KLIA Terminal 1; or
2. ii. upload the picture of the original purchase receipts (picture must be clean and clear), in the e-form/google form which shall be accessed via QR code provided by Eraman for the Contest ("QR Code") as follows:-

• c. All entries must be received by Eraman within the Contest Period and subject to Clause 3.3 below.

1. Eligible Customers may submit more than one (1) entry to increase the chance of winning the Prize (as defined and specified in Clause 3.1 below).

3. Contest Prize, Selection of Winner and Collection of Prize

1. For the purpose of the Contest and these Rules, "Prize" shall mean and be specified as follows:-

3. As specified in the schedule at Clause 3.1 above, a total of twenty-five (25) winners will be randomly selected to win the Prize and each selected winner is only eligible to win one (1) Prize throughout the Contest Period.
4. The winner for the Prize will be selected solely by Eraman as follows:-
5. a.The winner of Monthly Prize for November 2024 to January 2025 will be selected in a random drawing from all eligible entries which spent and submitted within 25th November 2024 until 31st January 2025;
6. b. The winner of Monthly Prize for February 2025 to March 2025 will be selected in a random drawing from all eligible entries which spent and submitted within 1st February 2025 until 31st March 2025;
7. c. The winner of Monthly Prize for April 2025 to May 2025 will be selected in a random drawing from all eligible entries which spent and submitted within 1st April 2025 until 31st May 2025; and
8. d. The winner of the Grand Prize will be selected in a random drawing from all eligible entries which were spent and submitted during 25th November 2024 until 31st May 2025. For the avoidance of doubt, the winner who has already been selected to win the Monthly Prize shall not be included in the random drawing for Grand Prize and shall not be selected to win the Grand Prize.
9. The selected winner of each Prize will be announced in Eraman's official social media (Facebook and/or Instagram) and Prize giving will be conducted every two (2) months via, as follows: -
10. a.The announcement of the selected winner and Prize giving of Monthly Prize for November 2024 to January 2025 will be conducted in February 2025;
11. b. The announcement of the selected winner and Prize giving of Monthly Prize for February 2025 to March 2025 will be conducted in May 2025;
12. c. The announcement of the selected winner and Prize giving of Monthly Prize for April 2025 to May 2025 will be conducted in June 2025; and
13. d. The announcement of the selected winner and Prize giving of the Grand Prize will be conducted in June 2025.
14. The Prize is given to the selected winner on an 'as is where is' basis, and is not transferable, not refundable, not returnable, not exchangeable and there is no cash alternative or whatsoever kind whether in part or full is offered. For avoidance of doubt, the selected winner shall not be allowed to enter any arrangement to change or substitute the Prize.
15. Picture(s) of the Prize shown in any advertisement, brochures, posters, promotion and/or other publicity materials relating to or in connection with the Contest is/are solely for illustration purposes only and may not depict the actual colour, model or specification of the Prize.
16. Any dispute in relation to quality, merchantability and/or warranty of the Prize (whichever applicable) must be settled directly by the selected winners with the dealer/supplier without recourse to Eraman. Eraman is not responsible for any breach of quality or warranty of the prizes or any terms and conditions thereof.
17. Eraman reserves the right to change or substitute the Prize with another prize of similar value without prior notice and without compensation.
18. Eraman is not responsible for all liabilities arising from any deferment, cancellation, delay or changes to the Prize details or any unforeseen circumstances beyond the reasonable control of Eraman.
19. Only Eligible Customers who fulfill the "Contest Mechanism and Eligibility" as stated in Clause 2 above shall have the chance to win the Prize. Incomplete entries and/or Eligible Customers who fail to fulfill the stated Contest Mechanism or Eligibility shall automatically be disqualified from the Contest without any prior notice.
20. The selection of winners by Eraman shall also be made based on verification by Eraman that the personal information and purchase details provided by the selected winners via the Contest Form or the QR Code are valid and true.
21. Eraman reserves the right to change or defer the announcement date of selected winners or the way of announcement of the selected winners, at its absolute discretion. The selected winners hereby give their explicit consent for their personal information including but not limited to photograph, name and age, to be produced, announced and/or posted on any place, location and/or platform by Eraman at Eraman's absolute discretion. The announcement of the selected winner by Eraman shall not be considered as final confirmation of the Prize entitlement.
22. Eraman will only attempt to contact the selected winners via email and up to two (2) times via phone call, at the email address and phone number as provided in the entry(ies) submitted by the selected winners through the Contest Form or the QR Code, prior to any official announcement. Eraman shall not be held accountable in the event the selected winners refused to, failed to, neglected to, are unable to and/or cannot respond and/or be contacted for whatsoever reason after such attempt and Eraman has the absolute right to select the next eligible winner by following the same procedure as mentioned in Clause 3.3 above.
23. The selected winners or their appointed representative shall be present when collecting and/or claiming the Prize on the date and at the date location specified by Eraman.
24. The selected winners are required to produce the following documents for verification prior to Prize collection: -
25. hardcopy of the official notification email or announcement by Eraman; and
26. original and photocopy of personal identification (NRIC (MyKad) or passport, which displays the full name, photograph and age of the selected winner).
27. In the event the selected winners appoint representative to collect the Prize, such representative shall produce the following documents prior to Prize collection: -
28. Name and identification number (NRIC (MyKad) or passport number) of both selected winner and the appointed representative.
29. Original and photocopy of appointed representative's personal identification (NRIC (MyKad) or passport).
30. Hardcopy of the official notification email or announcement by Eraman.
31. Photocopy of selected winner's personal identification (NRIC (MyKad) or passport, which displays the full name, photograph, and age of the representative).
33. Eraman shall not be held accountable in the event the selected winners or the appointed representative refused to, failed to, neglected to, are unable to and/or cannot be present and/or attended to collect the Prize for whatsoever reason on the official date of Prize giving or within one (1) month from that date or any time period specified by Eraman or the selected winner is ineligible to win the Prize upon verification by Eraman. Eraman has the absolute right to select the next eligible winner by following the same procedure as mentioned in Clause 3.3 above or disqualify the selected winner without any prior notice.
34. The selected winner or the appointed representative shall be required to sign a letter of acknowledgment prior to claiming/collecting the Prize from Eraman. Eraman reserves the right to reject any claim/collection of Prize should the selected winners or the appointed representative fail, refuse and/or neglect to produce any of the required documents OR fail, refuse and/or neglect to sign the letter of acknowledgment OR the selected winner ineligible to win the Prize upon verified by Eraman.
35. The selected winners are fully liable and responsible for any liabilities, mishap, injuries, losses, damages, costs, expenses, claims or accidents (including personal injury and/or death) as a result of or arising from their participation in the Contest, usage of the Prize and/or collection of the Prize. All transportation, accommodation, personal costs and/or any other incidental costs, fees and/or related expenses incurred by the selected winners or the appointed representative when claiming/collecting the Prize are at the sole responsibility of the selected winners.
36. Selected winners shall be responsible for any additional costs, duties, taxes, rates, government fees or any other charges that may be levied against them under the applicable laws, and/or other incidental expenses, which may be incurred as a result and/or related to their acceptance of the Prize.
37. Eraman reserves the right not to entertain any request for the return of the Prize by the selected winners after the execution of the Prize's letter of acknowledgement by the selected winner of the appointed representative.
38. All decisions of Eraman on all matters related to the Contest shall be final, conclusive and binding. No correspondences, queries, disputes or appeals in respect of any decision of Eraman shall be entertained.

4.Governing Law and Jurisdiction

These Rules are governed by the Malaysian law and the courts in Malaysia shall have the exclusive jurisdiction upon any issues arising from these Rules and/or the Contest.

5.Liability & Responsibility

1. Eraman, its related and associated companies, and its agencies and companies associated with the Contest disclaim any and all liability arising from the Contest and shall not be responsible and/or be held liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person's negligence) resulting from any Eraman customer's participation in the Contest, redemption and/or usage of the Prize.
2. By participating in the Contest, the Eligible Customers agree to defend, indemnify and hold Eraman harmless from and against any suits, claims, losses, damages, costs and expenses, including reasonable legal fees incurred by the Eligible Customers that may arise from or in connection with the Contest, and the Eligible Customers agree to release Eraman from any liability, losses, damages, and any kind of claims and actions incurred by the Eligible Customers in relation to the Contest, including but not limited to those resulting from the acceptance, possession, use or misuse of the Prize, or any Prize-related activities taking into account, without limitation, injury, death, and property damage.
3. Eraman shall not be held liable or responsible for any delay and/or failure in the receipt of entry due to the inability of the respective Internet Service Provider [ISP] company and/ or telecommunication network to provide timely and/or efficient internet and/or telecommunication services.

6.General

1. By submitting an entry to participate in the Contest, the Eligible Customers is deemed to have read, understood these Rules and the Eligible Customers hereby is fully and unconditionally agreed and accepted to be bound by these Rules and specific requirement herein (if any) including in relation to the Personal Data and Privacy Notice (as defined in Clause 6.3 below).
2. These Rules prevail over any provisions or representations contained in any advertisement, brochures, posters, promotion and/or other publicity materials relating to or in connection with the Contest.
3. By submitting an entry and the Personal Data to participate in the Contest, the Eligible Customers shall be deemed to have accessed and/or read the Privacy Notice, and the Eligible Customers hereby accept, acknowledge, and explicitly consent that Eraman shall have the right to use, process, and share the Eligible Customers' Personal Data in accordance with the Privacy Notice. The participating Eligible Customers acknowledge and agree that Eraman is relying on this consent for the purposes of its compliance with data privacy regulations, including but not limited to Malaysia's Personal Data Protection Act 2010. The participating Eligible Customers are further deemed to grant Eraman the absolute and unrestricted right to modify, use, and publish any still or moving images of them for any promotional, marketing, commercial, or other related purposes, without any payment or compensation. The Privacy Notice of Eraman and MAHB's group of companies applies and is available at https://www.malaysiaairports.com.my/en/about-us/corporate-profile/our-policies or upon request ("Privacy Notice").
4. Eraman offers no warranty or representation whatsoever, express, implied or statutory, in relation to the Contest, the Prize including but not limited to the merchantable quality and fitness for purposes in respect of the Prize. For the avoidance of doubt, Eraman is the party organizing and implementation of the Contest. Any queries relating to the Contest should be made directly to Eraman.
5. Eraman reserves the right to withdraw, cancel, suspend, extend, or terminate the Contest earlier either in whole or in part and further reserves the right to change, vary, revise, amend, modify, supplement, delete and/or add any Rules including the mechanism of the Contest from time to time at its absolute discretion without any prior notice. For avoidance of doubt, any such cancellation, suspension, extension, termination of the Contest and/or change, variation, revision, amendment, modification, supplementation, deletion or addition of these Rules by Eraman shall not give the Eligible Customers any right to claim compensation against Eraman for any or all losses or damages suffered or incurred by the Eligible Customers whether as a direct or indirect result of the act of cancellation, suspension, extension, termination of the Contest and/or change, variation, revision, amendment, modification, supplementation, deletion or addition of these Rules.
